Surrogacy is legal in Canada, however, compensated or commercial (for fee/profit) surrogacy is prohibited. Under the Assisted Human Reproduction Act passed in 2004, a surrogate may only be reimbursed for surrogacy/pregnancy related expenses. This form of surrogacy is called “altruistic surrogacy”. Although compensated or commercial surrogacy is common throughout the United States, intended parents cannot pay a Canadian surrogate any sort of wage, fee or compensation for carrying their child.
